These Terms of Service govern your use of the BitTool website, mobile application, and related services made available by BITTOOL PTE. LTD. Please read them carefully. By downloading, accessing, or using BitTool, you agree to these Terms.

1. About BitTool

BitTool is a self-custodial cryptocurrency wallet application. It is software that helps users create or import wallets, view public blockchain data, manage supported digital assets, and prepare, sign, and broadcast blockchain transactions.

BitTool does not take custody of user assets. BitTool does not hold your private keys for you. BitTool does not operate as a bank, broker, exchange, custodian, money transmitter, or investment adviser through the wallet software itself.

2. Eligibility

You may use BitTool only if you are legally permitted to do so under the laws that apply to you. By using BitTool, you represent that your use of the wallet and any supported digital assets is lawful in your jurisdiction.

If you are using BitTool on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. Self-custody and control

BitTool is designed for self-custody. You are solely responsible for your wallets, devices, private keys, seed phrases, passwords, biometrics, backups, and security settings.

Your seed phrase is the master credential for many wallets. If you lose it, you may permanently lose access to your assets.

4. Blockchain transactions

Blockchain networks are decentralized systems not controlled by BITTOOL PTE. LTD. When you use BitTool to submit a transaction, the actual transaction is processed by the relevant blockchain network and related infrastructure providers, not by us.

You acknowledge that blockchain transactions may be irreversible, may fail, may be delayed, may incur network fees, and may be affected by congestion, forks, validator behavior, smart contract logic, third-party infrastructure, or other events outside our control.

You are solely responsible for verifying addresses, amounts, token contract addresses, supported networks, transaction parameters, and recipient details before confirming a transaction.

BitTool is software, not financial advice. Nothing in the app, on the website, or in our support communications constitutes legal, tax, accounting, investment, or other professional advice.

BitTool does not execute trades for you, does not provide brokerage services, and does not recommend whether you should buy, sell, hold, or transfer any digital asset.

7. Network fees and third-party services

Your use of blockchain networks may require payment of network fees, miner fees, gas fees, rent, or similar charges. Those charges are determined by the relevant network or service provider, not by us.

BitTool may rely on third-party infrastructure or data providers for blockchain connectivity, transaction broadcasting, pricing, metadata, notifications, or similar functions. We are not responsible for the acts, omissions, availability, or terms of third-party services.

8. Intellectual property

The BitTool website, application, branding, logos, interface design, text, graphics, and software components made available by us are owned by BITTOOL PTE. LTD. or our licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use BitTool for your personal or internal business use in accordance with these Terms.

9. Disclaimers

BitTool is provided on an “as is” and “as available” basis, to the maximum extent permitted by law. We do not guarantee that BitTool will always be available, uninterrupted, timely, secure, accurate, or error-free.

We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee the availability or functionality of any blockchain network, digital asset, token standard, smart contract, node, validator, or third-party infrastructure provider.

10. Limitation of liability

To the maximum extent permitted by law, BITTOOL PTE. LTD. and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or digital assets.

This limitation includes losses arising from, or related to, lost credentials, unauthorized access caused by device compromise, incorrect addresses, unsupported assets, failed backups, smart contract vulnerabilities, blockchain failures, forks, congestion, validator or node failures, third-party service issues, market volatility, or your own mistakes.

Where liability cannot be excluded but can be limited, our aggregate liability to you for claims arising out of or relating to BitTool will not exceed the greater of one hundred Singapore dollars (SGD 100) or the amount you paid us directly, if any, for the relevant service in the twelve months before the event giving rise to the claim.

11. Indemnity

You agree to defend, indemnify, and hold harmless BITTOOL PTE. LTD. and its affiliates, officers, employees, and agents from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to your use of BitTool, your violation of these Terms, or your violation of any law or rights of a third party.

12. Suspension or termination

We may suspend, restrict, or terminate access to the website or supporting services if we reasonably believe it is necessary to protect BitTool, users, or third parties, or to comply with law. Because BitTool is self-custodial software, suspension of website or support access does not mean we control or can seize your wallet or assets.

13. Changes to BitTool or these Terms

We may modify these Terms from time to time. The updated version becomes effective when posted, unless a later effective date is stated. We may also modify, suspend, or discontinue parts of BitTool at any time.

Your continued use of BitTool after updated Terms become effective means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or BitTool shall be subject to the exclusive jurisdiction of the courts of Singapore, unless applicable law requires otherwise.
